New Delhi: The central government today issued guidelines for social media and over-the-top (OTT) platforms. Union Ministers Prakash Javadekar and Ravi Shankar Prasad held a press conference this afternoon to announce the regulations. A new law will be introduced by the central government to control digital content in the country. The new laws will be implemented in the next three months, announced Union Minister Ravi Shankar Prasad.

The new guidelines will apply to social media platforms such as Facebook and Twitter, as well as OTT platforms such as Netflix, Amazon Prime and Hotstar. ‘There should be a proper mechanism for social media companies. Social media should do business in India but double standard will not work ‘, said Ravi Shankar Prasad in a press conference.

The Supreme Court has directed to formulate one guideline each regarding fake news and social media. Concerns have also been raised in Parliament. There have also been a number of complaints regarding social media. Through this, wrong pictures are spread. The same social media is also being used for crime, said Ravi Shankar Prasad.

Social media companies need to set up a mechanism for complaints. Complaints must be addressed within 15 days. At the same time, it has to be clarified how many complaints were received and what action was taken on them. It is also necessary to state who first posted the offensive text. If the evils started from outside India, then who started them in India, it has to be said, the rules will be binding on social media.

Today, social media has given voice to the common man but at the same time it has given responsibility. If these conditions are not met, action will be taken against those concerned as per the IT Act, the Union Minister clarified.

‘Social Media Policy’

– There are two types: Social Media Intermediate and Significant Social Media Intermediate

– Everyone has to set up a grievance redressal mechanism on the platform. The complaint will be lodged within 24 hours and resolved within 14 days

– Content needs to be deleted within 24 hours if there is a complaint against users, especially for violating the dignity of women.

– Significant Social Media will require a Chief Compliance Officer who is a resident of India

– There should be a nodal contact person who will be available 24 hours for legal systems

– You have to say who first shared offensive content on social media

– Every social media company should have an address in India

– Every social media platform should have a verification system for users

– Rules for social media will be applicable from today. Significant social media intermediaries will have a three-month period

Guidelines for OTT platforms

– OTT and digital news media have to provide detailed information about themselves. Registration is not mandatory for them.

– Both will have to set up a grievance redressal mechanism. If a mistake is noticed, it will have to be corrected yourself

– OTT platforms will have to create self-regulatory bodies. It will be headed by a retired Supreme Court judge or eminent person

– There should be age-based certification system for OTT as well as censor board. The code of conduct will remain the same for TV and cinema.
