New Delhi: A contempt petition has been filed in the Supreme Court against the appointment of new Delhi Police Commissioner Rakesh Asthana. The petition alleges contempt of court against Prime Minister Narendra Modi and Union Home Minister Amit Shah. Asthana’s appointment is a violation of Supreme Court rules, alleged petitioner’s counsel Manohar Lal Sharma.

All such appointments should be notified by the Central Public Service Commission and any such officer with less than six months of service should not be appointed to the post of DGP or similar, the petitioner said. L. Sharma has said in the petition.

Rakesh Asthana is a former director of BSF. He has held various positions in the CBI. He was to retire on July 31, 2021. But he has been given an extension of one year and has been appointed as the Delhi Police Commissioner. The post of Delhi Police Commissioner is the same as the post of Director General of Police of any state.

Prime Minister Modi and Home Minister Amit Shah have disobeyed the Supreme Court order. As a result, he has lost his moral and constitutional right to remain in office, Sharma claimed in the petition. The matter should be heard before a bench of the Supreme Court. The bench of this Supreme Court consists of at least 5 judges. The bench should decide the matter by ordering such appointments. Otherwise, the situation will be violated and the public will lose faith in the country, said petitioner Sharma.

Sharma has named Prime Minister Modi and Amit Shah as defendants in the petition. Apart from this, the Home Ministry has also been made a defendant. All three have violated the July 2018 order of the Supreme Court.
