Giving rights to the states does not mean that the backward community got reservation. Although the state government declared the Maratha community as SEBC (socially and educationally backward community), the state has already used 50 per cent of the reservation quota. As a result, the Supreme Court has ruled in the Indra Sahani case that reservations cannot be made beyond the 50 per cent limit unless there is an unusual situation in the state. Then how can such communities take advantage of reservation ?, was the question raised by Chhatrapati Sambhaji Raje. In many states, there is a need to give additional reservation to various socially and educationally backward communities, said Chhatrapati Sambhaji Raje.

1. The Central Government should take steps to increase the reservation limit to 50 per cent for those states which can prove to be socially backward.

2. Although there is no Far Flung situation in some states, the decision in the Indra Sahani case was considered an extraordinary situation beyond the 50 per cent reservation limit. Yet the population in some societies may be excluded from the mainstream for exceptional reasons. This should allow the states to consider these criteria as extraordinary, said Chhatrapati Sambhaji Raje.

The 127th Amendment Bill will give back to the states the right to give reservation to a backward community. The bill was passed unanimously by MPs from all parties in the Lok Sabha.
