Justice Gautam Bhaduri and Justice. On March 21, a bench headed by Sanjay S. Agrawal granted leave to the petitioner’s counsel Adv. A. K. Tiwari said. The bench quashed the order passed by the Chief Justice of the Family Court at Durg on 22 April 2016 and referred the case to the Family Court for decision on merit under Section 3 (b) (ii) of the Act. The court directed the parties to appear in the family court.

Rajeshwari, daughter of Bhunu Ram, an employee of Bhilai Steel Plant, had filed the petition in the Durg Family Court under the Hindu Adoption and Maintenance Act, 1956. She had demanded around Rs 20 lakh as marriage expenses through this petition. The family court had on January 7, 2016, rejected the application, stating that there was no provision in the law for a girl to sue her parents for the cost of her marriage. Defendant Bhanu Ram is about to retire and is likely to get Rs 55 lakh during his retirement. Therefore, Bhilai Steel Plant should be ordered to transfer Rs 20 lakh from this amount to her name, she said.
