According to the petitioner, it is unconstitutional, un-Sharia and illegal to marry or polygamize in the Muslim community without the permission of the first wife. She says the issue of Muslim women needs to be regulated by law.

The petition states that it is unconstitutional for a Muslim husband to marry two or more wives without proper arrangements for the first wife or wives. If a Muslim man wants to remarry after a marriage, he has to get the written permission of the first wife and a certificate from the husband certified by a government official. The petition also said that he should be able to take proper responsibility of all the wives. Muslim men should disclose information about their previous marriages when they get married. The petitioner has also sought legislation to make registration of Muslim marriages compulsory. The petition was filed in the Delhi High Court by a woman named Reshma.
