Release of 11 convicts in Bilkis Bano gang rape case, how did they get out, what was the incident?

Ahmedabad: 11 convicts serving sentence for the gang-rape of a woman Bilkis Bano during the Godhra riots in Gujarat have been released today. This decision was taken as per amnesty policy of Gujarat government. After this decision of Gujarat government, 11 convicts were released from Godhra Jail.

Godhra riots took place in Gujarat in 2002. On March 3, 2002, Bilkis Bano was gang-raped in Randhikpur village of Dahod district. So, seven members of his family were killed. Bilkis Bano was five months pregnant when she was raped. An FIR was filed against Radheshyam Shahi, Jaswant Chaturbhai Nai, Keshubhai Vadania, Bakabhai Vadania, Rajivbhai Soni, Rameshbhai Chauhan, Shaileshbhai Bhatt, Bipin Chandra Joshi, Govindbhai Nai, Mitesh Bhatt and Pradeep Modhia. The accused were arrested in 2004.

The hearing of this case had started in Ahmedabad. However, the Supreme Court transferred the case to Mumbai in August 2004 after Bilkis Bano alleged that pressure would be put on the witnesses and suspected that the evidence collected by the CBI could be tampered with.

On January 21, 2008, a special CBI court in Mumbai convicted 11 accused. He was sentenced to life imprisonment in this case. The Bombay High Court also upheld this sentence. These convicts had served 18 years in jail. Radheshyam Shahi had approached the Gujarat High Court seeking remission of sentence under Sections 432 and 433. However, as there was no decision there, he filed a petition in the Supreme Court. Shahi had served 15 years and 4 months in jail till April 1, 2022. The Supreme Court had said that since the crime took place in Gujarat, the Gujarat government can take the decision.

The Supreme Court had directed to consider the application under the amnesty policy dated July 9, 1992. It was ordered to take a decision in this regard in two months. Panchmahal Collector Sujal Mayatra had asked the Gujarat government to take a decision by the Supreme Court. After that the government formed a committee headed by the collector. The committee members unanimously decided to release the convicts and recommended to the government. After that, their release was ordered.
