Convicts released in Bilkis Bano case after approval of Union Home Ministry: Gujarat Govt

Ahmedabad : Bilkis Bano, a woman, was gang-raped during the 2002 Godhra riots in Gujarat. 11 convicts in that case were released in the month of August. This decision was taken in accordance with the amnesty policy of the Gujarat government. After this decision of Gujarat government, 11 convicts were released from Godhra Jail. This decision of the Gujarat government was challenged in the Supreme Court. The Gujarat government has submitted an affidavit in the Supreme Court in this matter. It is said that the convicts in the Bilkis Bano case have served 14 years and were released due to their good behavior. In the same affidavit, information has been given about whose opinion was sought for the release of 11 convicts, who opposed the release and who gave consent. 11 people were released after the Central Home Ministry’s letter dated July 11, 2022 agreed to the release of the convicts, the Gujarat government has said in an affidavit submitted to the Supreme Court.

Consent of Union Home Ministry

According to the affidavit submitted by the Gujarat government to the Supreme Court, the Union Home Ministry, in a letter sent to the Gujarat government on 11 July 2022, agreed to the release of the convicts in the Bilkis Bano case before the completion of their sentence. According to the Gujarat government’s affidavit, the convicts applied for early release on February 23, 2021. On March 11, 2021, an opinion was recorded from the Superintendent of Police, CBI, SCB Mumbai that the convicts should not be released. On March 22, 2021, the Special Judge, CBI, Mumbai City Civil and Sessions Court gave an opinion against the acquittal of the convicts citing the Government of Maharashtra’s decision dated April 11, 2008.

According to the letter dated March 7, 2022, the Superintendent of Police, Dahod, Gujarat clarified that there is no objection to the release of the convicts. According to the letter dated 7 March 2022, the Collector of Dahod also informed that he had no objection. The Jail Superintendent of Godhra Sub District Jail also informed that there is no objection to the release of the convicts. According to the letter dated May 26, 2022, the Prisons Advisory Committee gave a unanimous opinion in favor of the release of the convicts.

The Home Department of the Government of Gujarat was informed on 9 June 2022 by the Additional Director General of Police, Jail Reforms Administration, Ahmedabad that there was no objection to the release. The Home Department of the Government of Gujarat wrote a letter to the Union Home Ministry on 28 June 2022 recommending the release of the 11 convicts before the expiry of their sentence and requesting consent for the release and orders to that effect. The Union Home Ministry sent a letter to the Gujarat Government’s Home Department on July 11, 2022 and approved the release of the convicts.

Acquitted convicts

The Gujarat government has submitted to the Supreme Court that Radheshyam Shahi, Jaswant Chaturbhai Nai, Keshubhai Vadania, Bakabhai Vadania, Rajivbhai Soni, Rameshbhai Chauhan, Shaileshbhai Bhatt, Bipin Chandra Joshi, Govindbhai Nai, Mitesh Bhatt and Pradeep Modhia were released on August 10, 2022 after completing all the procedures.
