Bulldozer action in Uttar Pradesh; Supreme Court pierces state government’s ears

News Agency, New Delhi: The Supreme Court on Thursday advised to uphold the law on bulldozers operating on the homes of suspected criminals. The court directed the state government to respond to the petitions in this regard.

The Uttar Pradesh government has launched a campaign to demolish the buildings with bulldozers by staging violent protests against the state government and unauthorized houses of suspected criminals in the riots in the state. Following this, similar action has been taken in BJP-ruled Madhya Pradesh. A petition was filed in the Supreme Court against the bulldozer operation in Uttar Pradesh. She was arraigned on Thursday by Justice A.J. S. Bopanna and Vikram Nath appeared before the bench. Without giving any interim order, the bench directed the Uttar Pradesh state government to reconsider. ‘Every action must be taken with a pure intention. State government departments should strictly abide by the law, ‘he said, adding,’ How can we guarantee security during this operation? One thing we want to clarify. Relevant suspects are also an integral part of society. If anyone has a complaint against them, they should be given a chance to present their case. If the court did not come to his rescue, it would not be appropriate, ‘the bench said.

The Muslim organization Jamiat Ulema-e-Hind has filed a petition in the Supreme Court against the bulldozer operation. The petition seeks that the houses of the suspects in the violent protests in the state should not be demolished. The petition also directed the state government not to take such action without notice and without due process of law.

Legal process completed

Solicitor General Tushar Mehta, appearing for the Uttar Pradesh government, and senior advocate Harish Salve, appearing for the Kanpur and Prayagraj Municipal Authorities, claimed that all legal proceedings for the action had been completed. He also pointed out that a notice was issued to the concerned unauthorized constructions in August, 2020. He asserted that his confession had been obtained through torture and that his confession had been obtained through torture.

No suspension of action

While ordering the Uttar Pradesh government to give an explanation about the action, the Supreme Court refused to stay the action.
